Whales dont eat the birds on purpose ;) They're merely emerging for air. Only killer whales will actively try to eat a human, and those will attack pretty much anything anyway.

Maybe you should look at this gif again their are no birds on the water until the whale comes chasing the fish to the surface then the birds swoop in to eat the fish
